More Visa Backlogs and Immigration Delays Ahead

It appears that soon the Visa Bulletin, which governs the allocation of immigrant visas, will backlog, even further, the cutoff date for employment based “EB-2” as well as possibly the EB-3 categories. The reason is twofold:

  1. There will be fewer unused visa numbers spilling down from the EB-1 category;
  2. There will be far fewer unused family-based visas spilling over to the EB (employment based) categories.

In the past two years, many family-based visa numbers were not used due to the Trump slowdown of the immigration process and COVID closing consulates. These unused visas were allocated to the EB system. But as family-based visas are now being used, there will no longer be more EB visas than the minimum 140,000 allocated.

This means some needed medical professionals, cancer researchers, cyber security engineers and other EB-2 and EB-3 applicants will need to wait longer for immigration.
