  • E-2 Treaty Investors

    E-2 nonimmigrant classification allows a national of a treaty country (a country with which the United States maintains a treaty of commerce and navigation) to be admitted to the United States when investing a substantial amount of capital in a U.S. business.   • Ext. Ability

    Persons of "extraordinary ability," "outstanding researchers or professors" or people on “national interest” may apply for permanent resident status through the EB-1 program without applying for a labor certification from the Department of Labor, which can take years to obtain. Examples of EB-5 cases

  • A Regional Center Hotel Project

    Mrs. W.Y. from China invested in a Regional Center real estate project in a major West Coast city. Her source of funds involved savings over time. This was thoroughly documented. The project was built. Her I-526 petition was approved and she is now a conditional resident.

  • A Direct Restaurant Project

    Mrs. S from Pakistan established and invested in a restaurant in California with her U.S. relatives. Her EB-5 funds were derived from the sale of real estate. The restaurant is open today. It is anticipated that the restaurant will expand to soon employ more than the needed 10 full-time workers. Her I-526 has been granted.

  • Direct Urgent Care Project

    Dr. D from India is working in the U.S. on an H-1B visa. He also has an EB-2 green card application on file, but the EB-2 quota for India is very backlogged. For his EB-5 petition, he created an urgent care medical practice. His I-526 was granted and his adjustment of status to conditional permanent resident status was approved. He is now expanding his new business to create the needed 10 full-time jobs.

  • Child Aging Out

    Mrs. N from Vietnam applied for an EB-5 immigrant visa after investing in a Regional Center real estate project. Her daughter was about 19 years old. Mrs. N’s I-526 was granted after proving her lawful source of funds as well as path of funds. Her daughter’s age was frozen upon filing the I-526. They applied for their immigrant visas at the American Consul in Ho Chi Minh City, Vietnam. While Mrs. N’s daughter was over 21, she was able to immigrate because her age had been frozen. Both of their I-829s are now pending with the USCIS.

  • A Regional Center Hotel Project

    Mr. C from Europe has been working in the U.S. on an E-2 visa (temporary investor visa). He made an investment in a Regional Center hotel project. His funds came from his successful European technology business. His I-526 was approved and his adjustment of status was granted. He is now a conditional resident. The hotel is open and jobs have been created. Please note that each case is different and past success does not guarantee future approval.
